Please read as this contains important information concerning your booking.
Sea Kayak Shetland Booking, Cancellation and Activity Terms and Conditions
You must read this document carefully. By proceeding with Your booking You accept these Terms and Conditions. References to “You” and “Your” means Yourself as the client booking the trip together with all other individuals on whose behalf You are making a booking. References to “Us”, “We” and “Our” means Jason Fenn trading as Sea Kayak Shetland, of Kinbreach, Eswick, Shetland, ZE2 9PS.
Booking and Payment
When a date and outline trip details have been agreed between Us and You, then payment of the price in full for each participant You are booking for is required to confirm and secure Your booking. Your booking will be made for a preferred booking date agreed between Us.
You can make payments by any lawful means other than by cheque provided the money We receive is the full amount You owe for Your booking. You are responsible for paying any charges levied by Your bank when the payment leaves Your account plus any bank charges levied by Our bank when the payment is received in Our account.
If You wish to make any amendments to Your booking once it has been confirmed, then please contact Us in writing as soon as possible via the info@seakayakshetland.co.uk email address with full details. If these amendments are urgent then please telephone on +44 (0)7974 387463. We will try to accommodate Your requested amendments but You understand and accept that it may not always be possible for Us to do so.
Cancellation by You
If You cancel Your booking more than 28 days before Your preferred booking date then a full refund of Your booking payment will be given after deduction of a £20 administration fee.
If You cancel Your booking less than 28 days but more than 14 days before Your preferred booking date then a refund of 50% of Your booking payment will be given.
If You cancel Your booking less than 14 days before Your preferred booking date then no refund of Your booking payment will be given.
Cancellation by Us
We will always endeavour to run Your booked trip. However, the comfort and safety of all participants is Our primary consideration. You understand and accept that the geographical nature of The Shetland Islands means that weather and/or the conditions on the sea may be unsuitable or unsafe for Your booked trip or any preferred location requested by You. You accept that weather conditions, especially wind strength, can be unpredictable and can change quickly in The Shetland Islands.
We may have to amend or wait to select a venue for Your trip as late as the day of Your booked trip based on weather and/or sea conditions and We will keep You updated in relation to weather and/or sea conditions, location selection and any changes to location by email, text and/or phone. You understand that We do not cancel trips because it is raining.
In the event that on reasonable grounds We believe the cancellation of Your trip is necessary due to unsuitable or unsafe anticipated conditions, We will notify You of Our decision to cancel Your trip and We will try to reschedule Your trip by offering You an alternative date or dates or the option of a full refund.
Medical Information
You agree that You are physically fit for Your booked trip. If You have any concerns about Your fitness, medical conditions, medication or ability levels it is Your responsibility to contact Us to discuss these before booking. If Your paddling ability or physical fitness levels are not appropriate for Your trip, We may need to cut short Your participation for safety reasons. You will not be eligible for a refund unless We expressly advised You that the trip would be appropriate and Your ability and/or fitness levels on the day of the trip are the same as they were when you described them to us.
You will be asked to fill in a participation and emergency contact form prior to Your trip. You should provide details of all of Your medical conditions and/or all medication You are taking. You should discuss this with the Us on the day of the trip if You are unsure whether a medical condition is relevant. It is helpful for Us to know about even minor issues involving Your vision, balance, hearing and co-ordination such as colour-blindness, motion sickness and dyspraxia. You are responsible for carrying any medication you may need during Your trip and making its location known to Us if we may need to administer or assist You with it.
Safety and Responsibilities
All participants under the age of 18 must be accompanied by a parent or legal guardian.
Our trips are planned and run in a way designed to manage the risk of accident to both clients and guides, whilst providing an enjoyable and suitably challenging outdoor adventurous experience. All outdoor adventurous activities by their nature inherently involve a degree of hazard and risk, including risk of personal injury, and cannot be completely risk free. Despite the greatest care accidents may still occur. You and all those You are booking on behalf of should be aware of and accept these risks and be aware that involvement places You at risk of accident and potential injury.
We will only be liable for any loss, damage, injury or death caused by Our negligence. We will not be liable for any loss, damage, injury or death caused by the actions or negligence of a third party (including another client) while You are involved in Our trip. We strongly recommend that You take out appropriate travel, cancellation, curtailment, and personal accident insurance to cover Your trip to Shetland and the activities You are undertaking with Us. Any vehicles parked are left at the owner or driver’s risk, We accept no liability for any loss or damage and they are not covered by Our insurance.
We will do Our best to accommodate medical conditions, but if We believe they will affect Your safety or anyone else’s, having regard to the nature of sea kayaking, We may refuse to allow You to take part in a trip. A refund will be offered in those circumstances, unless We have reason to believe You deliberately withheld information that could cause Us concern. If You have any concerns about a medical condition it is Your responsibility to contact Us to discuss these before booking.
You should inform Us immediately if You are unhappy or feel the trip activity is beyond Your ability.
You agree to listen to and follow instructions given by Us and in the event that You do not, We reserve the right to remove You from the trip with no refund of Your payment. If You choose to leave the group, We will no longer be responsible for Your safety but you will remain responsible for all equipment provided to You by Us until You return it to us.
Data Protection
We do not sell, lease or share Your personal data with anyone, except as required by law and with the emergency services in the unlikely event of an incident or accident.
Photographs
We normally take photographs during Our trips which will be sent to all participants on each trip.
We may use some of these photographs for Our business and social media platforms. If You do not wish to be photographed at all or do not wish to be visible in any photographs used in social media then make Your preference known to Us at the start of Your trip.
